About Jason Bice

Jason is a native of Ragland, Alabama. He served in the United States Marine Corps and graduated from Jacksonville State University. Before attending law school, Jason worked as a District Executive for the Boy Scouts of America and worked as a Pharmaceutical and Marketing Representative. Jason graduated from the Thomas Goode Jones School of Law at Faulkner University in Montgomery, Alabama. During law school, Jason won the CALI Award for Wills and Trusts and became a founding member of the school’s chapter of the Phi Alpha Delta Law Fraternity. Upon completion of law school, he received the school’s specialized certificate in Alternative Dispute Resolution.

Jason has legal experience with the Troup County Public Defender’s Office and District Attorney’s Office for the Tallapoosa Judicial Circuit. Jason and his wife Crystal live in Temple, Georgia. He is a member of the Georgia State Bar Association and is licensed to practice in all courts throughout Georgia.

Douglasville Attorney Jack Clay Introduces Justice David Nahmias of the Georgia Supreme Court at the West Metro Trial Lawyers' Association Luncheon

On Friday, January 29, 2010, Douglasville attorney Jack Clay spoke and introduced Justice David Nahmias to a crowd of fellow lawyers and local judges. Jack Clay was named as the first Chairman of the West Metro Trial Lawyers Association (WMTLA) in June of 2009. Thus far, this group of local lawyers dedicated to preserving the civil justice system for Georgians has hosted an evening party attended by local judges and elected officials. The WMTLA also hosted lunch featuring David Poythress, candidate for Georgia Governor, as a guest speaker. In the fall of 2009, the group hosted a bicycle helmet give-away booth at the Paulding County Public Service Appreciation Day.

We are grateful that Justice Nahmias came to speak to our group about his perspective as a recent appointee to the Georgia Supreme Court. Justice Nahmias graduated from Harvard Law School at the top of his class and served as an editor of the Harvard Law Review with President Barack Obama. After law school, he served as judicial clerk for Justice Scalia of the United Supreme Court. He has held many roles in the federal justice system working in the fight against terrorism. Prior to being appointed Justice of the Georgia Supreme Court by Governor Sonny Perdue, he served as the United States Attorney for the Northern District of Georgia.

Justice Nahmias is a cordial, engaging, and a articulate speaker. He is also running for election this year. We are grateful that he chose to come and speak to our group.

Douglasville Chili Cook Off a Success

Last Friday night, despite the rainy and chilly weather, my office set-up our booth at the annual downtown Douglasville, Georgia chili cook off. We had decided our "theme" would be fall-related, and we included a few scarecrows, leaf arrangements, and even Christmas lights to make our booth stand out. We were pleased with the turnout and enjoyed being part of the Douglas County tradition. Below, find photos from the event. We were graciously provided with a hand-carved pumpkin to display our firm name and we named our chili "Break a Leg Chili" to remind the community of the types of cases we handle.

Our Douglasville Injury Law Firm Gets Into the Fall Spirit This Week

I have mentioned this week about the upcoming chili cook off in downtown Douglasville, Georgia as well as blogged about safety precautions for the upcoming Halloween weekend. I wanted to take a moment to show some pictures of our law office lobby decorated in celebration. We plan to use these same decorations for our cook off booth.

In continuation from my earlier post about traffic safety due to road closures, I read an interesting article about precautions to take as a pedestrian. The following is a list of suggestions to consider when out on the roadways this weekend:

1. Be sure to carry a flashlight or other reflective device if walking on Halloween after dark. Make sure your children's costumes incorporate this idea as well.
2. Make sure you and your children wear sturdy, supportive shoes to avoid slip and falls.
3. Follow all road signs and safety procedures, such as looking both ways before crossing busy streets.
4. It is a good idea to walk in a single-file line down the roads, rather than in a large clump. This will ensure the safety of your group.
5. Be careful of masks that may obscure your vision.
6. Always be a defensive pedestrian - be aware of others around you at all times.

I hope that all West Georgia residents enjoy this holiday and remember these safety measures to avoid an untimely accident. Annual Downtown Douglasville, Georgia Chili Cook-Off Moved to a New Date

This year, my office has decided to participate in the annual chili cook-off held in O'Neal Plaza in downtown Douglasville. The event is hosted by the Cultural Arts Council.

The date for the cook-off has been moved due to unexpected weather changes. The cook-off will now be from 6:00 pm to 9:00 pm on Friday, October 30, 2009. We hope to see many Douglas County residents that evening!

We will have marketing materials available at our booth. As you know, my office handles personal injury and workers' compensation cases in the West Georgia area. Workers' Compensation CLE Seminar

Last week, I attended a workers' compensation seminar in St. Simon's Island, Georgia. The seminar, sponsored by ICLE and Workers' Compensation Law State Bar of Georgia, was attended by many work comp attorneys and hosted several activities over the three day event. Guest speakers included several judges from the State Board of Workers' Compensation in Atlanta, Georgia including Chief Judge William S. Cain, Jr., Honorable Carolyn C. Hall, and Honorable David K. Imahara, among others. Some of the topics discussed were case law updates, the basics of taking depositions, recent decisions of the appellate division, and discussions regarding catastrophic designations in workers' comp cases.

Spotlight: Coweta County, Georgia Justice Center Located Southwest of Atlanta, Georgia in Newnan, Georgia

Last week I visited the Coweta County Justice Center while working on a car accident case. The Justice Center was built in early 2006 and houses Coweta County Superior Court, Coweta County State Court, and the offices of the clerks for these courts. The Center also contains offices for the Solicitor-General and District Attorney of Coweta County. Below, I have included pictures I took while at the Justice Center. Apparently the Center was designed to resemble the county’s courthouse, where other offices are still located, and to fit in with the area’s style.

Coweta County, located approximately 40 miles southwest of Atlanta, Georgia, has a population of just over 120,000 according to the 2008 U.S. Census report. Cities within Coweta County include Newnan, Haralson, Palmetto, and Sharpsburg to name a few. The Justice Center was less than an hour’s drive from my Douglasville law office where I handle personal injury cases, including auto accidents and truck wrecks, and workers' compensation cases.

Injured & Need An Attorney? Beware: Not All Injury Attorneys Are The Same, Whether You Are In Atlanta, Douglasville, or Elsewhere.

I heard an interesting comment today from one of the Georgia's top attorneys. Our discussion was about attorneys who treat the practice of law like a business instead of a profession. He made the remark that some lawyers get a new file and their first thought is what the amount of money that can be made in the least amount of time. WRONG! I am reminded daily that, like wine, cases can take a long time to properly develop. In fact, Orson Welles said famously, "We will sell no wine before its time." A print of this quotation hangs on a wall in my office to remind me and, occasionally, my clients of the virtue of patience.

When selecting an attorney, please keep in mind that any attorney can advertise on television, have a fancy yellow pages ad, have a professionally designed website, or provide you with information in the form of pamphlets or booklets. Don't judge a book by its cover. Look beyond the surface to see what you are really getting. If I were looking for an attorney, I would evaluate the following factors carefully:

(1) Testimonials from former clients and references - One of the marks of good attorneys are satisfied clients. Ask for references. You wold not hire somebody without references. Why put one of the most important decisions you will make in the hands of somebody who cannot or will not provide references? While it is true that the identity of clients is strictly confidential, our office makes it a practice to keep a list of client references. These are past clients from whom we have received specific permission to disclose their contact information for prospective clients to call.

(2) Legal and trial skills or the "when push comes to shove factor" - Make no mistake about it, insurance companies and their attorneys care about the caliber of lawyer on the other side. When cases do not settle, they will inevitably size-up your attorney from their past experience and reputation of the attorney involved. There are numerous traits that good lawyers across the board seem to possess. Unfortunately, it may be difficult or impossible for a client to tell whether an attorney is really good. The best attorneys I know:
- Have mastered the substantive area of law in question
- Possess the wisdom and common sense to properly evaluate circumstances, strengths, and weaknesses
- Are diligent and push their cases forward -- in other words, they act instead of being acted-upon
- Understand what works and what does not work with judges and juries
- Understand the Rules of Evidence and Civil Procedure which permeate all injury cases whether it is a car accident case, defective product matter, or workers' compensation claim
- Communicate effectively
- Have experience taking cases to trial with a track history of success

(3) Specialization - The days of the general practitioner are become more and more numbered. Potential clients who are seriously injured should pick an attorney who specialized in one or two areas of law. Lawyers simply cannot be all things to all people and excel. I recommend asking the prospective attorney to tell you what percentage of their practice is devoted to your specific type of case.

(4) Organizations and community - Any attorney can join legal organizations. Pick a leader in the legal profession and the community. Ask the prospective attorney what leadership roles they have held in the past or currently hold. In my opinion, this is an indication of dedication to a profession, not merely the business of law. Or, put another way, it is the difference between passion versus a paycheck. Some attorneys are more interested in staying in their offices to make as much money as possible instead of offering a meaningful contribution to the legal profession by being leaders in organizations. We receive many referrals from other lawyers. I advise prospective attorneys to not only ask for past client references, but also ask for references of other lawyers in the community who have referred injury cases to the attorney you are considering hiring.

(5) Caseload and confidence - The attorney you hire should maintain a reasonable caseload and spend enough time with you during the first appointment to get to know you and your case. Many attorneys will send non-lawyers to your home to gather information and sign paperwork. Never hire a lawyer without meeting with the attorney personally at his or her office. You should feel comfortable and confident in their ability. Part of being a good lawyer is a limited caseload so the proper time and attention can be devoted to your case. You should connect with your attorney. Remember, if your case goes does not settle and goes to trial, you absolutely want the jury to connect with your attorney.

Lawyers Should Avoid The Ghost of Chirstmas Past & Embrace Technology

Attorneys can be very resistant to change. Ebenezer Scrooge, in A Christmas Carol, was visited by the Ghost of Christmas Past. Ebenezer learned from this experience the necessity to change his past ways to ensure a happier and brighter future.

I am constantly amazed by fellow lawyers' reactions when I tell them I strive to have as paperless an office as possible. Some are skeptical. Some say it is not possible. Others tell me they are too old fashioned for that sort of thing. Some call me later for advice and help in implementing their own paperless systems. I am here to tell you that it is possible. You too can implement a paperless system in your office, whether your firm has 500 lawyers or you are a sole practitioner. Even though I am a sole practitioner on the outskirts of a major city with limited resources, my system has worked very well for our office.

A good starting point is to buy a good scanner. Personally, we use a Canon ImageRunner 5000-series all-in-one machine. While this machine is quite large and expensive if purchased new, I purchased one used for substantially less than the new price. Another alternative that many of my friends use is the Scan Snap series from Fujitsu. Whatever hardware you choose, be sure to carefully plan a system for scanning, cataloging, and electronically filing your documents . We use a simple process whereby all scanned documents are "dumped" into a common folder in our database. From there, they are named and electronically filed in their respective folders.

I also use a Canon IP90 portable printer that fits nicely into my briefcase. Of course, I can print documents with a few clicks when I head to court. November and December were busy months for me. I handled several hearings before the State Board of Workers' Compensation. My trial exhibits were created with ease with the Canon machine. I also toted my small portable printer to court where I printed additional documents I needed. Going paperless has increased my capacity to produce work product.

One Lawyer's Perspctive After Using Google's Picasa 3 To View Photos & Documents

I have been using Picasa for several years to view photographs. Lately, I have been reviewing our photographs in past and present case files. For those of you who do not use Picasa, it can be wonderful tool for workers' compensation lawyers, personal injury attorneys, or any other specialty for that matter. For example, it scanned my current and some past client files and found over 3,000 photographs from my years of practice. I was surprised at the number and variation of pictures we have including:

- photos from auto accident scenes;
- wrecked cars and truck;
- pictures of injuries;
- photographs of surgical procedures;
- scars;
- photos of Georgia Panels of Physicians in our workers' compensation cases;
- photographs of x-rays (in addition to original x-ray films);
- pictures of clients' homes after modifications in catastrophic workers' compensation and injury cases;
- clients performing tasks such as sitting, standing, kneeling walking up and down stairs, etc. to show limitations due to injuries;
- pictures of dangerous conditions at construction sites and factories where my clients have been injured;
- photos of parties to case, including defendants;
- and photos of books and other items used in depositions. For example, I deposed a doctor once and saw a medical book authored by him on the coffee table in the lobby. I snapped a quick photo and used it during my direct examination.

Picasa is a great way to view and organize these photographs. We have also started reviewing documents in .tiff format using Picasa. TIF is a file format now owned by Adobe that has not been updated since 1992. One problem I have noticed, however, happens when you view multi-page documents in Picasa. There does not seem to be a way to view multiple pages. Essentially, Picasa shows the first page of the document. Perhaps there is a way to resolve this situation.

While my paperless law office scans and views documents in .pdf format, whenever possible, many courts use .tiff format. Some use several formats. For example, the State Board of Workers' Compensation ICMS seems to use. tiff as a default for scanning incoming "paper documents", but uses .pdf for many documents created by attorneys. Federal courts throughout the country use the .pdf format for documents on its Pacer / ECF systems. In Georgia, we have a group called the Georgia Courts Automation Commission. Sadly, however, we have yet to implement a uniform electronic filing and case system throughout our state court system here in Georgia. I am hopeful that this will happen over the next ten years.

Atlanta Botanical Garden Construction Accident Involving Atlanta-based Hardin Construction Company Investigated by OSHA

Today, Angel Chupin, a 66 year-old construction worker, was killed and 18 others were injured when a tragic construction accident occurred on a construction site at the Atlanta Botanical Gardens. The workers were completing construction on a dramatic walkway through the Gardens when it collapsed, sending workers falling to the ground. Some fell as far as 40 feet. The injured workers were taken to Grady Memorial Hospital with various injuries.

I wrote some time ago about the role of OSHA in workers' compensation cases. I expect that a thorough investigation by OSHA will take place after this tragic accident.

I have also written extensively about how, often, workers are barred from suing their employer and co-employees when their injuries fall-under Georgia's workers' compensation laws. However, there can be third parties who bear responsibility who can be sued in these instances. My observation is that this issue has been the hot topic of Georgia's appellate courts this year. There have been numerous decisions this year about the interplay between the Exclusive Remedy Provision, which limits workers' ability to file a civil suit, and tort law. Elect Beau McClain for Douglas County Superior Court Judge

I am endorsing Beau McClain for Douglas County Superior Court Judge. Beau is a friend and colleague. This is a sound decision in support of a good man. Beau is currently the Chief Assistant District Attorney for Douglas County. He is a career prosecutor. After graduating from Emory Law School in the early 1980's, he immediately began working as a prosecutor fighting crime in Georgia. Forgive me for editorializing, but I feel compelled to call it like I see it. We live in an era of politicized judicial appointments. I am certain that Beau McClain passed-up lucrative opportunities in ivory towers over the many years he has served the public in the Douglas County District Attorney's Office. He devoted his career to fighting crime and developing outstanding courtroom skills. He is smart, capable, and his integrity is beyond reproach.

I will tell you that I have had cases against Beau McClain in past years. In fact, we first met opposing each other in a case. Now, I stand proudly in support of Beau. In an era when the public views the media as its decision making compass, we hear a lot noise, spin, and conjecture. Beau's central campaign themes are commitment to justice, community, and family. The following observations are my personal observations, not things I have heard from others or read about somewhere. I can comfortably say Beau McClain lives his life in accordance with these things. He believes in justice. Make no mistake about it - - his history as a prosecutor for nearly 30 years speaks volumes to his commitment to the legal system and keeping all of us safe. Beau is also devoted to the community. Having started an organization called Faith in Action and spending much of his free time helping the poor, he has real world experience as a community activist. He is a devoted family man, having been married for over 27 years to his wife Heather. They have three boys.

Allow me to make a final observation. My mother told me to surround yourself with good people. Beau McClain is a positive influence on me and, I am certain, many others. In November, please consider voting for Beau McClain for Douglas County Superior Court.

Lawyers in Douglasville, Georgia Celebrating Christmas & Birthdays

I have been very busy lately. We are into the Holiday Season and there is much work to be done. I wanted to wish everybody a very Merry Christmas and Happy New Year. Car accidents increase this time of year, even in Douglas County, GA where the winters can be mild. We have been fortunate to receive many referrals this year. Spotlight: Paulding County, Georgia Courthouse - Including Hiram, GA and Dallas, GA

Much of my personal injury and workers' compensation practice involves Paulding County, Georgia, in one way or another. Paudling County, GA, which includes the cities of Dallas, Georgia and Hiram, Georgia, is one of the fastest growing areas in the United States. There are a growing number of employers in Paulding County. In recent years, I have noticed a growing trend of work accidents and on-the-job injuries from residents living and working in Paulding County. Of course, many Paulding County residents travel to work in areas such as Atlanta and Cobb County and come to me for help. Another trend I have noticed in Paulding County, particularly in Hiram, Georgia, is an increase in car accidents. I have also handled a number of truck accidents that happen in the rural western portion of Paulding County.

Paulding County's population, according to recent census numbers is just over 120,000.00. There have been plans to replace the old courthouse pictured here with a new courthouse. The present courthouse, located on The Square in Dallas, Georgia, was built in 1892. It is listed on the National Register of Historical Places. It was designed by Bruce & Morgan utilizing a Queen Anne architectural style. In 2001, the Paulding County Courthouse was targeted by an arsonist and partially burned.

My New Douglasville Personal Injury & Workers' Compensation Law Firm in Douglasville Georgia

I apologize that my blogging has tapered off lately. I have received numerous emails from my readers lately wanting to read more about what I have to say. I am proud to announce that I have formed the Law Office of Jack Clay, LLC, which is conveniently located across the street from the Douglas County Courthouse in Douglasville, Georgia. The pictures that you see are of my office and the view from my office. I am sharing space in a very well located law building with a real estate attorney named Shawn Horan. I strongly recommend Shawn for real estate closings in Douglasville and West Georgia.

Of course, there has been much work to do. As my old partnership was dissolving, I found myself in a situation where I had to do some re-engineering. I am pleased to announce that my paralegal, Kari Holcombe, has made the transition with me. After five years of working with me, she is an incredible asset. I also recently hired another employee named Laurie Bell who serves as a legal assistant.

As in the past I am limiting my practice to litigation and trial work in the areas of Personal Injury (mostly automobile accident and tractor-trailer wrecks) and Workers Compensation. Douglasville, Georgia Injury Lawyer Begins Blog

The purpose of this blog is to provide information to the public and to serve as an information source for other attorneys, especially non-workers' compensation lawyers.  I find there is far too much bad information floating around out there.  As a Georgia workers' compensation attorney, I have confronted just about every conceivable question and concern from my clients.  Probably the most common fear expressed by my clients when they are injured is confusion.  Much of the confusion arises from the fact that workers' compensation has many pitfalls and nuisances. 

There are not a lot of attorneys that practice in the area.  The State Bar of Georgia currently lists 953 lawyers who are members of the Workers' Compensation Section.  I would estimate that of the 953, about 500 practice a great deal of workers' compensation law.   Keep in mind that the last time I checked, there were over 20,000 attorneys licensed to practice law in Georgia.  That translates to about 1 in 40 lawyers.

The current Census figures tell us the population of Georgia is just over 9,000,000.  That translates to about 1 workers' compensation attorney for every 18,000 people. 

My goal is simply to clear-up the confusion and discuss various issues important to injured workers, their families, and the legal community.
